Avandia Information

            Type 2 is the most common form of diabetes.  The body does not produce enough insulin or the cells ignore the insulin.  Fortunately, we are learning much more about Type 2 diabetes and a person diagnosed with this serious disease can live a long and happy life.  The American Diabetes Association says that there are 23.6 million Americans with diabetes.  Of that amount, 5.7 million have not yet been diagnosed.

            In 1999, GlaxoSmithKline received approval for a drug for treatment of Type 2 diabetes called Avandia.

            On May 21, 2007, the U.S. Food and Drug Administration published a safety alert for Avandia.  The report states that  “…Safety data from controlled clinical trials have shown that there is a potentially significant increase in the risk of heart attack and heart-related deaths in patients taking Avandia…”  The warning goes on to state that GlaxoSmithKline provided the F.D.A. with a pooled analysis of “…42 randomized, controlled clinical trials in which Avandia was compared to either placebo or other anti-diabetic therapies in patients with Type 2 diabetes.  The pooled analysis suggested that patients receiving short-term (most studies were 6-months duration) treatment with Avandia may have a 30-40 percent greater risk of heart attack and other heart-related adverse events that patients treated with placebo or other anti-diabetic therapy.  These data, if confirmed, would be of significant concern since patients with diabetes are already at an increased risk of heart disease…”

Aviation Accident Information

                On October 8, 2008, a Yeti Airlines was attempting to land at the airport in Lukia, Nepal when the main landing gears snagged a security fence.  The plane crash and caught fire.  Eighteen of the nineteen persons on board were killed.  Only the pilot survived.

                The day before, a Qantas Airbus made news when it suffered a sudden drop in altitude while in flight.  Although there were no fatalities, 36 people sustained spinal injuries, broken bones and lacerations.

                On August 20, 2008, there were 154 fatalities when an airliner taking off from Madrid, Spain swerved off the end of the runway, crashed  and burst into flames.  There were only 18 survivors.      

                The Atlanta Journal-Constitution reported on October 17, 2008 that the National Transportation Safety Board recommended that the F.A.A. require inspections of jets with the Pratt & Whitney PW2037 engine after a Delta flight from Las Vegas on a Boeing 757-232 had to return to the gate after the pilot heard a loud bang and saw that the right engine had lost power.  Missing lugs and cracks were found in the turbine hub.  Cracks in the turbine hubs of American Airlines planes were also found.

Snowmobile Accident Information

Carbon Monoxide Information

           You can’t see, smell or taste carbon monoxide but, at high levels, it can kill a person within minutes.  Whenever any fuel such as gas, kerosene, wood, oil or charcoal is burned, carbon monoxide (C.O.) is produced.  The same is true whether you reside in a single family home or an apartment.  Properly utilized and maintained, most appliances do not give off hazardous levels of C.O.  However, malfunctioning or improperly used appliances cause hundreds of accidental deaths per year. 

            The United States Environmental Protection Agency states that “…Prevention is the Key to Avoiding Carbon Monoxide Poisoning…” You can protect your family in your home by:

Having all of your fuel-burning appliances checked by a professional.  This includes flues and chimneys.

            Choosing appliances that vent fumes outside whenever possible.

Providing proper ventilation by opening a window slightly if you must use an unvented gas or kerosene space heater.

            Installing a C.O. detector/alarm.  .

            Never idle your car in the garage – even if the garage door is open.

            Never use a gas oven or range  to heat your home.

            Never use a charcoal grill in the house.

            Do not sleep in a room with an unvented gas or kerosene space heater.

            Do not use gas powered engines in enclosed spaces.

            Never ignore symptoms of C.O. poisoning.  These include: headaches, dizziness, mental confusion, nausea or feeling faint.  If  you experience these symptoms, you should get fresh air immediately by opening doors and windows, shutting off combustion appliances and leaving the house.  You should also go to the emergency room for treatment. 

            If you or someone you love is the victim of CO poisoning which was caused by the negligence of a third party (such as a utility company, landlord, etc.), you may have legal recourse for your damages.

Work Injury Information

             Did you know that workers who are injured in the course of their employment have two possible sources of compensation for their injuries?    

            The first is a worker’s compensation claim.

            Suppose you are an over-the-road truck driver.  You live in West Virginia.  Your company is based in Arkansas.  You were hired in Virginia.  You were involved in an accident in New Jersey.  Do you know where you would bring a claim for workers compensation benefits?  Not many people do.  This can be a real puzzler even for an attorney, if he isn’t experienced in workers compensation claims.

            Workers compensation claims can be incredibly complicated and the compensation you receive could vary from state to state.  It is important to know where you can bring a claim and the best state in which to make your claim.
